Earlier this year, the Peruvian Congress adopted a bill imposing a 10-year moratorium on the introduction of GMOs into the country (see BIS of 10 June 2011). However, that bill was not ratified by the then President.
 
Recently, three main commissions of the Congress have re-approved the moratorium and discussions have been ongoing with respect to the duration of the moratorium. On 3 November 2011, the Congress overwhelmingly approved a 10-year moratorium that prohibits GMOs from being imported for cultivation or to be raised locally (Item 1). The bill has to be now signed into law by President Ollanta Humala and all indications are that he will do so.
 
In a complementary development, the Peruvian Ministry of Agriculture has enacted a Supreme Decree that prohibits the competent authority from accepting applications for the environmental release of GMOs in the agriculture and forestry sector, if the competent sectoral authority for agriculture does not have baseline information on native agrobiodiversity.

Peru’s Congress approves 10-year GMO ban

LIMA – Peru’s Congress announced Friday it overwhelmingly approved a 10-year moratorium on imports of genetically modified organisms in order to safeguard the country’s biodiversity.
 
The measure bars GMOs – including seeds, livestock, and fish – from being imported for cultivation or to be raised locally.
 
Exceptions include the use of GMO products for research purposes in a closed environment, but those will be closely monitored, the legislature’s official news service said.
 
The bill, approved late Thursday, now goes to President Ollanta Humala to be signed into law. Humala, who has been in power since late July, has repeatedly said he opposes GM programs.
 
According to the Agriculture Ministry, Peru is one of the world’s leading exporters of organic food, including coffee and cocoa, with $3 billion a year in revenues and 40,000 certified producers.
Congress approved a similar 10-year moratorium in June, but outgoing president Alan Garcia, who was seen as being favorable to GM, did not ratify the ban.
 
There was friction over GM in the previous government’s ministries of agriculture and environment.
 
The head of Peru’s Consumer Agency, Jaime Delgado, said the moratorium is long enough to learn from scientific studies that will emerge on the effects of GMO products.
 
The country’s leading group representing farmers and ranchers, the National Agrarian Convention, said that by this measure Peru “defends its biodiversity, its agriculture, its gastronomy and its health.”

Dicton Normas sobre seguridad de la Biotecnologia en el desarrollo de actividades con organismos vivos modificados agropecuarios o forestales y/o sus productos derivados
 
DECRETO SUPREMO
No 011-2011-AG
 
EL PRESIDENTE DE LA REPUBLICA
 
CONSIDERANDO:
 
Que, mediante la Ley No 27104, Ley de Prevención de Riesgos derivados del uso de la Biotecnologia, se regula la seguridad de la biotecnología de conformidad con la Constitución Politica del Perύ y el Convenio de Diversidad Biológica, aprobado por Resolución Legislativa No 26181:
 
Que, mediante Resolución Legislativa No 28170, se aprobó el Protocolo de Cartagena sobre seguridad de la Biotecnologia del Convenio sobre la diversidad Biológica, instrumento jurídico internacional que dista los procedimientos para el control del movimiento transfronterizo de Organismos Vivos Modificados;
 
Que, mediante Decreto Supremo No 108-2002-PCM, se aprobó el Regiamento de la Ley No 27104, Ley de Prevención de Riesgos Derivados del uso de la Biotecnologia;
 
Que, el Articulo 60 del citado Reglamento constituye como Organo Sectorial Competente – OSC o Autoridad Nacional Competente para el sector Agricultura al Instituto Nacional de Innovación Agraria – INIA, como responsable de la seguridad el manejo de la biotecnologica;
 
Que, el Articulo 70 del citado Reglamento define las funciones y facultades del INIA, como OSC del sector Agricultura, en material de regulación de la seguridad de la biotecnologia agropecuaria, entire ellas elaborar el Reglamento Interno Sectorial sobre los mecanismos y procedimientos para la toma de decisiones y el fortalecimiento institucional (Literal b);
 
Que, mediante Decreto Supremo No 003-2011-AG, se aprobó el Regiamento sobre Seguridad de la Biotecnologia en el desarrollo de actividades con Organismos Vivos Modificados agropecuarious o forestales y/o sus productos derivados;
 
Que, el Articulo 560 del citado Reglamento establece las funciones del SENASA para el control del ingreso de OVM material de importación o tránsito internacional;
 
Que, el Articulo 570 del citado Reglamento establece que, las solicitudes de permisos de importación y tránsito intercional o autorizaciones para la importacion de productos de uso Agricola o productos veterinarios y alimentos para animals, deberán contener dentro de la declaración, lo referido a si el product es un OVM agropecuario o forestall y/o product derivado del mismo;
 
Que, se hace necesario implementar medidas de vigilancia y control en los puntos de ingreso y salida del territorio nacional dirigidas a evitar el ingreso y liberación al Ambiente de semillas no autorizadas de Organismos Vivos Modificados;
 
En uso de la facultad conferida por el numeral 8) del articulo 1180 de la Constitución Politica del Perú y de conformidad con la Ley N0 29158. Ley Orgánica del Poder Ejecutivo y el Decreto Legislativo N0 997;
 
DECRETA:
 
Articulo 10 – La autoridad competente no admitirá solicitudes relacionadas a las actividades de introducción para liberación al medio ambiente de Organismos Vivos Modificados – OVM, mentras el órgano sectorial competente del sector agricultura no cuente con las lineas de base de la agrobiodiversidad nativa, que permita una adecuada evaluación de las actividades de liberación al ambiente de OVM.
 
Articulo 20 – Todo material genético vegetal que ingrese al territorio nacional deberá acreditar su condición de no ser Organismo Vivo Modificado, para lo cual los Laboratorios de Detección Official deberán realizar los análisis que determinen dicha condición.
 
Articulo 30 – El SENASA realizara el control de posibles ingresos de OVM en embarques de semillas u otro material genético del ámbito agropecuario material de importación, en todos los puntos autorizados a nivel nacional, sean estos maritimos, fluviales, terrestres o aéreos, mediante la toma de muestras al azar, las cuales serán derivadas al laboratorio official de detección de OVM para los análisis que correspondan.
 
Articulo 40 – El INIA, deberá acreditar las competencias de su laboratorio para actuar como laboratorio de referencia y/o certificador de la condición de no OVM de semillas u otro material genético del ámbito agropecuario materia de importación y/o exportación.
 
Articulo 50 – Designar temporalmente al laboratorio de detección de OVM del INIA como el Laboratorio Official de Detección de OVM del sector Agricultura que actuará como referente para los procesos de detección, identificación y cuantificación de OVM a nivel nacional en materia de productos agropecuarios y forestales. Asimismo, será el encargado de realizar las certificaciones para los materiales agropecuarios de exportación que requieran un análisis de presencia de OVM, en tanto acredite sus competencias para actuar como laboratorio de referencia y/o certificador de OVM del sector agricultura.
 
Articulo 60 – El Organo sectorial competente del sector Agricultura y el SENASA deberán de implementar los procedimientos y actividades para el cumplimiento de la presente norma.
 
Articulo 70 – El presente Decreto Supremo será refrendado por el Ministro de Agricultura.

Article 3 – The SENASA [National Service of Agrarian Health] will perform the control of potential introductions of LMOs in shipments of seeds or other agricultural/livestock genetic material subject to importation, at every authorized national point, in seas, rivers, land and air, through random sampling, that will be referred to the Official Detection Laboratories for analysis.
 
Article 4 – The INIA [National Institute for Agrarian Innovation} must demonstrate the competence of their own laboratory to act as a reference laboratory and/or to act as certifier of the condition of not being a LMO for seeds or other agricultural/livestock genetic material subject of importation and/or exportation.
 
Article 5 – To temporarily designate the detection laboratory of the INIA as the Official Detection Laboratory of LMOs for the agricultural sector that will act as a reference for the processes of detection, identification and quantification of LMOs at the national level for agriculture and forestry products. The INIA will be also in charge of performing the certification of farming materials for exportation that require an analysis for LMO presence, as long as it is accredited in its competence to act as a reference laboratory and/or as a certifier for LMOs in agriculture.
 
Article 6 – The competent sectoral Authority for the agriculture sector and SENASA will have to implement the procedures and activities for the fulfilment of the present regulation.
 
Article 7 – The present Supreme Decree will be authenticated by the Minister of Agriculture.

EL PRESIDENTE DE LA REPUBLICA
 
CONSIDERANDO:
 
Que, mediante la Ley No 27104, Ley de Prevención de Riesgos derivados del uso de la Biotecnologia, se regula la seguridad de la biotecnología de conformidad con la Constitución Politica del Perύ y el Convenio de Diversidad Biológica, aprobado por Resolución Legislativa No 26181:
